Terms of service.

By accessing or using Whole (the “Service”), provided by Whole Technologies Group Ltd, trading as Whole, a company registered in England and Wales (Company No. 17311922), you agree to be bound by these Terms of Service.

If you do not agree to these terms, you may not use the Service. We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify you of material changes by email or through the app.

Whole is a personal wellness platform that helps you plan, track, and reflect on your body, mind, and soul. The Service includes our web application, mobile applications, AI-powered features, and any associated content or tools.

The Service is provided for personal, non-commercial use. You may not resell, sublicense, or distribute the Service without our written permission.

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised use of your account
• Take responsibility for all activity that occurs under your account

You must be at least 13 years old to create an account.

Whole offers free and paid subscription plans. Paid plans are billed monthly or annually, as selected at the time of purchase.

• Subscriptions renew automatically unless cancelled before the renewal date
• You may cancel at any time through your account settings
• Prices may change with reasonable notice

All prices are exclusive of applicable taxes.

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day cooling-off period for online consumer transactions. You may cancel a paid subscription within this period for a full refund. If you request that the Service begins during this period, you acknowledge that you may be charged a proportionate amount for the service already provided.

After the cooling-off period, you may cancel your subscription at any time. Your access will continue until the end of the current billing period. We do not offer refunds for partial subscription periods after the cooling-off period, except where required by law.

Nothing in these terms affects your statutory rights as a consumer under the laws of the country in which you reside.

The content and features within Whole, including AI-generated plans, recommendations, and guidance, are for informational and educational purposes only. They are not a substitute for professional medical, nutritional, psychological, or fitness advice.

Always consult a qualified professional before making significant changes to your diet, exercise, or mental health practices. Whole does not provide medical diagnosis, treatment, or advice.

You retain ownership of content you input into Whole, such as journal entries, logs, and goals. By inputting content, you grant us a limited, non-exclusive licence to use that content to provide and improve the Service.

You are responsible for ensuring any content you provide does not violate the rights of others or applicable law.

You agree not to:

• Use the Service for unlawful purposes
• Attempt to gain unauthorised access to any part of the Service
• Transmit malicious code or interfere with Service operation
• Scrape, copy, or redistribute content without permission
• Impersonate any person or entity

All content, features, and functionality of the Service, including but not limited to software, design, text, graphics, and branding, are the exclusive property of Whole Technologies Group Ltd and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, or create derivative works without our express written permission.

The Service may integrate with third-party services such as fitness trackers. Your use of those integrations is subject to the third parties’ own terms and privacy policies. We are not responsible for third-party services.

To the fullest extent permitted by law, Whole Technologies Group Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by applicable law.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these terms or for any other reason at our discretion.

You may terminate your account at any time by contacting us or through your account settings. On termination, your rights under these terms will cease, but certain provisions (including limitation of liability and governing law) will survive.

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in another jurisdiction, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these terms affects your rights as a consumer to rely on such mandatory provisions of local law.
